But the next step for Washington and State is likely to be a case involving a third party, the Brady Challenge, or a lawsuit brought by the Brady Campaign. The legal filing claims that the Brady Campaign has been "inventing and operating" the D.C. weapon files system for years, and that the government "has been using it for thousands of years since its inception." The campaign, for which D.C. is responsible, claims that, because Washington has been making and keeping thousands of files online for the last two decades, "the government has a fiduciary responsibility to continue to keep the records of the government that Congress is trying to regulate alive and well."

But this is the most dramatic case about what is going on the D.C. legal system right now. It is the first time the Brady Campaign has been able to sue for a lawsuit because of "the government's lack of control over the state's gun file system." As a result, it has been trying to block an order to stop the D.C. government from moving forward with the D.C. gun file system and is still trying to figure out how to stop it. The Brady challenge is the latest example of the D.C. federal government's growing power over the federal government which is pushing back against many of its own legal decisions and actions.

The D.C. government is in a difficult position to fight in its lawsuit with the Brady. It is still facing legal challenges from several states including New York, and if that court decision is appealed, it could have a huge impact on the state's ability to defend its own gun files against the federal government. The lawsuit might also force the state to sue state officials for making laws or regulations and then using the federal government to make these laws or regulations.

But that is the only way that the D.C. government can claim that its gun files system has been properly regulated. The D.C. government should be able to fight it by appealing to the Supreme Court to take a stand before the D.C. government is forced to shut down the gun files system and replace them with an online court record system that is so similar to the one in Washington v.
