"At the time of the purported takedown, the Defendants did not deny or deny the existence and validity of the Notice issued by DCJ, and the Defendant did not provide any evidence to support its authenticity," the attorneys' filing states.

"We ask DCJ to explain its decision to remove the notice from Cloudflare to the public."

In August, the state of New Jersey was ordered to pay $1 million in restitution to two alleged victims for illegally downloading the DMCA's "Takedown Notice," a document that purported to document the identity of the alleged victim and the date of the alleged takedown. The state also has the ability to require an Internet Service Provider to install a "Takedown Notice" on computers that download the DMCA.

The documents in the cases cited by NJ AG Moramarco "demonstrate that the defendant's online traffic was not a genuine traffic source and the defendant's traffic was not a legitimate traffic source for Defendant's website," according to the attorney's filing.
